Privacy Policy

According to article 13 of the European Regulation 2016/679 (hereinafter, the “GDPR”) and to the Legislative Decree 196/2003, as amended by the Legislative Decree 101/2018 of the 10th of August 2018 (hereinafter, the “Privacy Code”), we provide the following information concerning the processing of personal data collected through this site (hereinafter, the“Site”).

The present Privacy Policy is referred only to the Site and does not pertain to other websites, potentially accessible through hyperlinks.

Data Controller

The data controller in charge of the data processing hereby described is the professional association Lawyalty Avvocati Associati (hereinafter, equally, the “Law Firm” and/or the “Controller”) , with head office at Via Cappuccio no. 12, Milano, Italian Tax Number and VAT IT06784600964, represented by its legal representatives and associates Gem Gad Matalon, Filippo Moschini and Belén Dìaz Gutiérrez (established lawyer).

Type of data processed

The personal data processed through the Site are:

Data supplied voluntarily by the user

In order to use some of the services made available by the Site to the users and, more particularly, to send to the Law Firm curriculum vitae, presentation letters and/or requests of collaboration, the users shall insert their personal data in the “contact form” contained in the relevant section of the Site named “Work with us”. Only upon user’s explicit consent such data shall be sued by the Law Firm. The registration and, particularly, the user’s consent to the processing are required to allow the Law Firm to process the data transferred by the user while sending curriculum vitae, presentation letters and/or requests of collaboration etc.

The personal data processed can be, by way of example and not limited to, information related personal records, studies, professional and work experiences, contractual and remunerative conditions, references, motivations for change, preferences, aspirations, etc.

The optional, explicit and voluntary mailing of personal data for the above-mentioned purposes and/or of the email address to the addresses specified on the Site and/or in the relevant section named “Work with us”, leads to the subsequent acquisition of the sender’s address, which is necessary to reply to the requests, as well as of the other personal data contained in the related messages.

Browsing data

Information systems and software procedures used to operate the Site acquire, during the normal course of operation, come personal data whose transmission is implicit in the communication protocols of the Internet.

It concerns information that is not collected to be associated with specific individuals, but by their own very nature could, through the processing and association with data held by third parties, allow users to be identified.

This category of data includes IP addresses or MAC addresses of computers used by users who connect to the site, URI addresses (Uniform Resource Identifier) of requested resources, the time of the request, the method utilized to submit the request to the server, the size of the file obtained in reply, the numerical code indicating the status of the response from the server (successful, error, etc..) and other parameters related to the operating system and the users.

These data are used only to obtain anonymous statistical information on the Site and to check its correct functioning.

Cookies

Cookies are files or parts of information which are store on the hard drive of the user’s computer (files sent from the site’s server to the browser to the user of the same site) when navigating websites.

Cookies which are stored on the user’s computer cannot be used to retrieve any data from his hard disk, transmit computer viruses or identify and use email addresses. Every cookie is unique in relation to the browser and the device used by the user to access the Site.

Cookies are used for various purposes and have different characteristics; for this, they are divided in technical cookies; profiling cookies; session cookies; persistent cookies.

The stated types of cookies can be (i) “first party” cookies or “proprietary” cookies when they are managed directly by the owner and/or responsible/controller of the website being viewed; (ii) “third party” cookies when the cookies are placed and managed by thirty parties that are not the owners and/or controllers of the web site visited by the user.

  • Typology of cookies used:

The Site uses technical first party cookies, namely cookies that make quicker and easier the web surfing and the fruition of the Site. Technical cookies do not require user’s consent; therefore, they are automatically installed after the access to the Site and are not used for other purposes.

More specifically, there are:

No profiling cookies are used on this Site.

In addition, through the Site, are installed technical cookies coming from third parties’ sites, so of third parties that, through the Site are released on the user’s computer: these are the so-called third parties’ cookies, in particular the analytical cookies, that are anonymised analytical cookies which are used by the web sited providers to collect information, in aggregate form, on the number of users and on how they have visited the site, and to conduct general statistical analyses about the service and its use.

The Site collects third parties’ analytical cookies for statistical purposes, particularly through Google Analytics, a web analysis service provided by google. Google uses the data collected for the purpose of verifying the use of this Site, compile a report and share them with services developed by google

In addition, the site collects analytics cookies _ ga (which uses an anonymous identifier to distinguish individual users on the site that expire after 2 years) and _ gat (used to limit the amount of user requests in order to maintain site performance that expire after 1 minute). PURPOSE OF THE DATA PROCESSING

The personal data will be processed for the purpose of ensuring the browsing and the consultation of the Site and to comply with legal obligations.

The navigation data will be used in order to obtain anonymous statistical information on the use of the Site and to verify its correct functioning and, therefore, they are cancelled immediately after the processing.

The personal data provided by the users through the “contact form” in the relevant section of the Site called “Work With Us” including a Curriculum Vitae, will be used by the Law Firm for the only purpose of satisfy or reply to requests or communications made.

OPTIONAL DECISION OF CONFERRING THE DATA

Conferring the above-mentioned personal data is optional, nonetheless not conferring said data could make it impossible, for the Law Firm, to provide the service requested.

LINK TO EXTERNAL CONTENT

The Site may connect or address to other sites, services or external content that are outside the control of the Controller. Once the user has left the Site, the Controller will not be able to safeguard the security of the personal data of the user or be held responsible for the protection and privacy of any personal data that the user may have provided on other sites.

METHODS OF TREATMENT, PLACE OF CONSERVATION AND SCOPE OF ANY COMMUNICATION

Personal data are processed also with the help of automated tools, for the time strictly necessary to achieve the purposes for which they have been collected.

The processing of the personal data collected through the consultation or the use of the Site will be carried out at the offices of the Law Firm and will be managed by appointed personnel of the Law Firm, adequately identified, trained and formally appointed and, if needed, by its professionals.

In part, the said personal data are stored on third parties’ servers, suppliers of IT and electronic services (i.e. e-mail services, back-up services, data storage) having their office in EU member States, which respect all the security measures that are necessary to properly protect the personal data.

The user’s personal data will not be disclosed to third parties or released.

SECURITY

The personal data are collected and stored in a secure way, using technical procedures methods and organisational process suitable to safeguard and ensure information and data collected through the Site.

USERS’ RIGHTS

At any moment, according to articles 15 to 22 of the GDPR, the user can exercise the right to:

  1. request confirmation of the existence or not of his personal data;
  2. obtain information regarding the purpose of the processing, the types of personal data, the recipients or categories of recipients to whom the personal data have been or will be disclosed and, if possible, the storage period;
  3. obtain rectification and erasure of the personal data;
  4. obtain the restriction of the processing;
  5. obtain the portability of the data, that is to obtain them from the Controller in a structured format, commonly used format and readable by any electronic device, and to transmit them to another data controller without obstacles;
  6. oppose to the processing at any moment;
  7. oppose to any automated decision process concerning natural persons, including profiling;
  8. request to the Controller the access to the personal data, the rectification or the cancelation of said data or the limitation of the processing which concern the user or to object to their processing, other than the right to portability;
  9. revoke the consent at any moment without affecting the legitimacy of the processing based on the consent given before the revocation;
  10. present a complaint to a regulatory authority.

AMENDEMENT TO THE PRESENT PRIVACY POLICY

This Privacy Policy is entering into force from May 25th, 2018 and may be subjected to modification so as to comply with new legal regulations or change in policy regarding personal data processing.

Each updated version of this Privacy Policy shall be made available on the Site in the relevant section.
