REMOTE WORKING: STATUTORY OBLIGATIONS RETURN AS OF APRIL 1, 2022

With the state of emergency set to end on March 31, companies operating in Italy will no longer be able to offer employees the option of remote working (*smart working*) as a derogation from the regulations originally introduced by Law 81/2017.
The primary and most significant consequence will be the need for companies to enter into specific individual agreements with employees who continue to perform part of their work remotely after that date.
For larger, more structured companies, it may also be highly beneficial to establish a corporate policy on remote working. Such a policy could define guidelines applicable uniformly to all staff (or specific categories) and facilitate the drafting of streamlined, flexible individual agreements.
These are easily implemented measures that will allow for the continued use of a practice which recent experience has shown to be highly effective in balancing business needs with employees' quality of life.
